These Terms & Conditions govern your use of Emoshops (emoshops.com), a brand owned and operated by RETAINLY PRIVATE LIMITED, CIN U62099BR2026PTC081765 (referred to as “we”, “us” or “the Company”).

By accessing this website, creating an account, or making a purchase, you agree to be bound by these Terms. If you do not agree, please do not use the service.

1. What we sell

Emoshops sells digital collectible items representing emotions. Each item is a digital product delivered electronically to your account on this website. When gifted, the recipient receives a private link to view a personalised digital experience.

These are novelty digital goods purchased for personal and entertainment purposes. They are not investments, financial instruments, securities, or stores of monetary value, and they carry no resale, redemption, or cash value of any kind.

2. Eligibility

• You must be at least 18 years old to create an account and make purchases.
• You must provide accurate information and are responsible for activity on your account.
• Our service is currently offered to customers in India only.

3. Pricing and payment

Prices are shown and charged in Indian Rupees (INR), inclusive of applicable taxes unless stated otherwise. Prices are subject to change, but the amount shown at the time of purchase is the amount you pay.

Payments are processed by third-party payment providers. We do not store your card or banking details.

5. Limited editions and availability

Certain items are released in limited quantities or during scheduled time windows. Availability is not guaranteed. Items may sell out, and scheduled releases may be changed, delayed, or cancelled at our discretion.

Each item purchased is assigned a unique serial number at the time of purchase. Serial numbers are permanent and non-transferable.

6. Gifting

You may send a purchased item to another person along with a written message and, optionally, a voice recording. By sending a gift you confirm that:

• You have the recipient's consent to contact them;
• Your message does not contain unlawful, abusive, harassing, obscene, defamatory, or infringing content;
• You are not using the service to harass, impersonate, or cause distress to any person.

We reserve the right to remove any gift or message and suspend accounts that breach this clause.

7. Acceptable use

You agree not to:

• Create multiple accounts to obtain promotional credit more than once;
• Use automated means to access, scrape, or purchase from the service;
• Attempt to interfere with, disrupt, or gain unauthorised access to the service;
• Resell, sublicense, or commercially exploit items purchased on the service.

8. Intellectual property

All artwork, audio, text, designs, and software on this website are owned by the Company or its licensors. Purchasing an item grants you a personal, non-exclusive, non-transferable licence to view and gift that item through our service. It does not transfer ownership of any underlying intellectual property.

9. Service availability

We aim to keep the service available at all times but do not guarantee uninterrupted access. We may suspend or modify the service for maintenance, updates, or reasons beyond our control.

10. Limitation of liability

To the maximum extent permitted by law, our total liability arising out of or in connection with your use of the service shall not exceed the amount you paid to us in the three months preceding the claim. We are not liable for indirect, incidental, or consequential losses.

11. Termination

We may suspend or terminate your account for breach of these Terms. You may close your account at any time by contacting us. Promotional credit is forfeited on account closure.

12. Governing law

These Terms are governed by the laws of India. Any dispute shall be subject to the exclusive jurisdiction of the courts at Motihari, Bihar.
